In the legislation, it is considered to be fined the lack of labelling of the AI-generated content as a serious offence, punishable by fines up to 35 million euros, or up to 7% of the global revenues of the offending company.
It is also prohibited to promote subliminal techniques, through sounds and images that may manipulate risky groups. For example, using the content to spread messages that could incite gambling addictors, or toys that may influence children to perform risky challenges. It is also forbidden to classify people through biometric data, using AI as a tool for collecting the data.
While applying this measure, Spain is the first European country to apply the legislation requested by European Union regarding the use of Artificial Intelligence.
